THE ROLE OF THE INSS IN PROTECTING CONSUMER RIGHTS: A CRITICAL ANALYSIS OF AUTOMATIC DEDUCTIONS FROM RETIREMENT ACCOUNTS

In this work, we examine the performance of the National Social Security Institute (INSS) in protecting the rights of retirees and pensioners in the face of automatic deductions made by third parties from social security benefits. We investigate whether the administrative and regulatory measures adopted by the agency are sufficient to prevent abusive practices and ensure the financial integrity of insured individuals. Our general objective is to analyze the INSS's performance in protecting consumer rights, and our specific objectives are to identify the main types of deductions, evaluate existing control mechanisms, and propose possible improvements. We developed qualitative, exploratory research through a bibliographic survey of books, using content analysis to interpret the collected material. We found that, although a regulatory framework exists to govern deductions, weaknesses persist in the mechanisms for monitoring and preventing undue deductions. We conclude that, while it represents progress in protecting beneficiaries, the effectiveness of the new model depends on its proper implementation and the consolidation of administrative practices capable of safeguarding social security income.
