PREROGATIVES OF THE PUBLIC TREASURY IN COURT

This work focused on the general theme of the prerogatives of the Public Treasury when acting before the Judiciary. Furthermore, the research was classified as applied, with the following question as its problem: what prerogatives does the Public Treasury possess when acting in court to defend the interests of the community? To answer this question, the following methods were employed: bibliographic research based on the Federal Constitution, infra-constitutional legislation, and books and articles related to the topic. In this sense, the main objective of this article was to discuss the prerogatives of the Public Treasury when acting in court as enshrined in the Brazilian legal system, and its specific objectives were: the conceptualization of the Public Treasury; the enumeration of the prerogatives of the Public Treasury in court; and a discussion of the justifying foundations and prerogatives that the Public Treasury possesses in court within the legal system.
